Dutch authority publish guidelines on DSA for service providers
The Netherlands Authority for Consumers and Markets (ACM) has issued guidelines to help businesses understand the European Digital Services Act (DSA), covering various service types such as social-media platforms, search engines, online marketplaces, internet providers, and webhosting services. The guidelines clarify the compliance requirements and offer practical information for different business categories.
ACM has incorporated feedback from a public consultation with digital sector market participants into the final guidelines. Recognizing the need for practical guidance, ACM has focused on providing detailed information and will publish concise guidelines tailored to different business types.
The DSA came into force on 17 February 2024, introding new obligations for providers of online services to enhance internet safety and trustworthiness. The DSA mandates that online service providers maintain effective complaint-handling systems and transparency regarding their content moderation policies. The rules are designed to be proportionate, with fewer requirements for smaller businesses.
ACM, as the designated regulator for the DSA in the Netherlands, will begin enforcement actions once the Dutch implementing act is in force, expected in early 2025. In the interim, businesses and consumers can report non-compliance to ACM, aiding future enforcement efforts.
