EU Commission’s AI Act Impact Assessment to Simplify Rules for SMEs
The European Commission has announced an impact assessment for its 2025 work program, focusing on the AI Act as part of a broader digital package. Lucilla Sioli, Director of the AI Office, clarified during a panel discussion that while the Act will be included in the digital omnibus, no major review is anticipated. The Commission aims to simplify certain provisions, particularly for small and medium enterprises (SMEs), to address their unique needs and constraints.
Sioli further elaborated that the assessment will examine how the AI Act intersects with other legislation. This aligns with the Commission’s goal of ensuring the digital acquis reflects the operational realities of SMEs and mid-sized businesses. However, whether this implies reopening the AI Act remains uncertain, as Commission representatives have not confirmed such plans.
The digital package will also extend beyond AI regulation, addressing cybersecurity reporting and data-sharing rules. Commissioner Maroš Šefčovič confirmed these elements during a press conference, emphasizing the package’s comprehensive approach. Despite earlier references to the package as an “omnibus,” Šefčovič explicitly denied this characterization, leaving the scope and structure somewhat ambiguous.
A Commission spokesperson, Thomas Regnier, stated that no confirmation could be given regarding reopening the AI Act. The Commission has refrained from denying this possibility, adding to speculation about potential adjustments to the legislation. The ongoing assessment will likely determine the extent of regulatory updates required to balance innovation and compliance across the EU’s digital ecosystem.
