EU digital governance is too complex
In recent years, the European Union has introduced a comprehensive digital rulebook, highlighted by the Artificial Intelligence Act and the General Data Protection Regulation. This rulebook encompasses various laws on data access, cybersecurity, content moderation, and more. These efforts are part of a long-term strategy to position the EU as a digital superpower, resulting in approximately 100 tech-focused laws. However, this proliferation of legislation has led to significant complexity, with over 270 regulators involved in digital governance across the EU.
The intricate web of EU digital laws presents challenges for organizations striving to maintain responsible governance. The multitude of legal instruments, including secondary legislation and technical guidance, creates a complex compliance landscape. This complexity is exacerbated by the evolving nature of technology and societal expectations, making it difficult for organizations to navigate regulatory requirements effectively. The dispersion of legal texts adds to the confusion, complicating the implementation of digital governance.
For the EU’s digital ambitions to succeed, it is crucial for organizations to design and implement effective digital governance frameworks. The European Commission, under the leadership of Ursula von der Leyen, is tasked with ensuring these frameworks align with the overarching goals of the digital rulebook. The Commission must prioritize creating conditions that promote compliance and responsible governance, addressing the challenges posed by the current regulatory structure.
As the EU unveils its new policy agenda, it must focus on streamlining the governance structures to enhance the effectiveness of digital laws. By doing so, the EU can better serve the objectives these laws aim to achieve, fostering a digital environment that supports innovation while ensuring compliance with regulatory standards. The Commission’s role as the guardian of treaties is pivotal in monitoring and guiding the implementation of these laws across member states.
